Terms of Use – EXE

These Terms of Use (hereinafter "TOU") govern access to and use of the EXE platform (hereinafter "the Platform") by "Athlete" and "Coach" users. Registering for an account constitutes full and unconditional acceptance of these TOU.

• Athletes : a user who purchases or follows a training program.
• Coach : a professional offering programs and coaching services on the Platform.
• Services : all web and mobile features provided by EXE.
• Publisher : Younes Beaila, Sole Proprietor, operating the EXE Platform.

• Registration is reserved for persons aged 18 or over.
• Users must create a personal account with accurate and up-to-date information.
• Authentication is done via email and password (minimum 8 characters).
• Accounts are personal, non-transferable and must remain confidential.
• Users are responsible for all activity carried out from their account.

• Follow safety guidelines and consult a physician if necessary before starting a program.
• Do not share purchased content beyond strictly personal use.
• Report any medical or technical issue to support as soon as possible.

• Provide accurate information (qualifications, legal status, tax information).
• Comply with applicable professional regulations (insurance, taxation, social declarations).
• Ensure programs are high-quality, lawful and regularly updated.
• Comply with tax and social obligations related to their activity and provide transparent contractual information to their clients.

• Athletes : free access to the basic features; optional EXE Premium subscription governed by the Premium Terms of Sale. Coach programs are paid and settled at the time of order via Stripe (PSD2 compliant).
• Coach Starter : 15% commission on gross revenue collected (excluding payment processing fees).
• Coach Pro : monthly subscription with a reduced 5% commission, including the coach AI assistant and advanced tools.
• Coach Premium : monthly subscription with a 0% commission and advanced business tools.
• Coach payouts are made by Stripe Connect to the Coach's bank account, according to Stripe's payout schedule (7 days by default).
• VAT not applicable, article 293 B of the French General Tax Code.

EXE acts as a technical intermediary between Coaches and Athletes. Coaches remain solely responsible for program content and the support they provide. EXE provides the technical infrastructure, billing and technical support.

The EXE Premium subscription gives access to an AI assistant based on artificial intelligence models provided by Anthropic PBC. The sessions, programs and suggestions produced by this assistant are generated automatically; they do not constitute medical advice or a prescription and do not replace the advice of a healthcare professional. Details are set out in the Premium Terms of Sale.

• EXE uses reasonable means to ensure the availability and security of the Platform.
• EXE shall not be held liable for bodily injury resulting from inappropriate sports practice.
• The Publisher's liability is limited, to the extent permitted by law, to the amounts actually paid by the user during the preceding 12 months.
• EXE does not guarantee the suitability of programs offered by Coaches for each Athlete's specific needs.

EXE's trademarks, logos and interfaces are protected. Coaches retain ownership of their content and grant EXE a limited license for operating the Service. Any unauthorized reproduction is prohibited.

privacy policy details the data collected and user rights. EXE acts as data controller and hosts personal data within the European Union.

• Coaches : 30 days' notice; content is deleted on the requested end date.
• Athletes : immediate termination from the account; access to purchased programs depends on the Coach's terms.
• EXE may suspend or terminate an account in case of fraud, non-payment or violation of these TOU.

EXE may amend these TOU. Any substantial change is notified to users at least thirty (30) days before it takes effect, by email or in-app notification; a user who refuses it may close their account free of charge during that period. Continued use of the Platform after that period constitutes acceptance.

These TOU are governed by French law. In the event of a dispute, an amicable resolution will be sought first.

In accordance with articles L.611-1, L.612-1 and L.616-1 of the French Consumer Code, the consumer may use a consumer mediator free of charge.

EXE is finalising its membership with an accredited consumer mediator (official list at economie.gouv.fr/mediation-conso). The mediator's contact details will be published here as soon as membership is effective. In the meantime, any complaint may be sent to juridique@exefit.app; EXE undertakes to respond within 30 days.

Failing amicable resolution, the competent courts shall be those of the defendant's domicile or, at the choice of the consumer plaintiff, the place of effective delivery of the service.
